General terms and conditions of SWISSGESUNDHEITSSCHUH

 

 

1. Scope


The present "General Terms and Conditions" (hereinafter referred to as "GTC") regulate the rights and obligations of SWISSGESUNDHEITSSCHUH and the customer who purchases a product ("Products") via the online shop swissgesundheitsschuh.com.

SWISSGESUNDHEITSSCHUH reserves the right to change the GTC from time to time. The version of the SWISSGESUNDHEITSSCHUH GTC valid at the time the order is confirmed is decisive and cannot be changed unilaterally for this order.

 

2. Prices and terms of payment


The prices to be paid by the customer correspond to those in the specified currency that are valid at the time of the order confirmation by SWISSGESUNDHEITSSCHUH.

All prices stated in the online shop include Swiss VAT.

 

3. Conclusion of contract


The presentation of the products and the indication of prices on this website do not constitute a legally valid offer, but are a non-binding offer to the customer so that he can order products and conclude a contract.

SWISSGESUNDHEITSSCHUH does not transmit an order acceptance, but only confirms the receipt of the customer order. The actual delivery by SWISSGESUNDHEITSSCHUH is deemed to be acceptance of the order by SWISSGESUNDHEITSSCHUH and the contract is thus formed. This also applies to prepayments by the customer if, for example, SWISSGESUNDHEITSSCHUH debits the credit card account specified by the customer. SWISSGESUNDHEITSSCHUH reserves the right to reject the customer's contract offer and not to deliver the ordered products if they are not available from SWISSGESUNDHEITSSCHUH's supplier or the manufacturer. The publication of specifications, scope of delivery, etc. in the web shop is in no way legally binding; the actual specifications and scope of delivery specified by the product manufacturer at the time of delivery apply exclusively. If SWISSGESUNDHEITSSCHUH cannot deliver the ordered products in accordance with the customer's order (price and product specifications), the customer will receive a refund from SWISSGESUNDHEITSSCHUH for any advance payments that may have been made.

Unless confirmed in writing by SWISSGESUNDHEITSSCHUH, the delivery times given are only to be regarded as non-binding information, even though they are stated by SWISSGESUNDHEITSSCHUH to the best of their knowledge. This applies in particular to delivery problems on the part of the manufacturer. If a delivery is delayed beyond the date confirmed in writing by SWISSGESUNDHEITSSCHUH, the customer can set a grace period of at least three weeks. After the grace period has expired, the customer can withdraw from his order. Further claims are hereby excluded.

SWISSGESUNDHEITSSCHUH is entitled to cancel or not to deliver confirmed orders at any time, especially if SWISSGESUNDHEITSSCHUH itself is not supplied with products by its suppliers. In particular, the customer acknowledges that SWISSGESUNDHEITSSCHUH reserves the right to change the sales prices of the products, i.e. that prices may increase between the date of the order and the date of delivery by SWISSGESUNDHEITSSCHUH; in such a case, the customer is entitled to refuse delivery of the products. In this case, the customer will receive a refund of the purchase price paid for all undelivered products (even if a credit card specified by the customer is charged); Any further claims are hereby excluded.

Order changes or cancellations requested by the customer are only valid if they have been confirmed in writing by SWISSGESUNDHEITSSCHUH.

No guarantee is given for technical data and information on the scope of delivery, i.e. SWISSGESUNDHEITSSCHUH is not liable for damage caused by deviations from this information.

 

4. Payment and Delivery


The payment methods we accept are listed on our website.

SWISSGESUNDHEITSSCHUH only charges credit cards when the ordered products are shipped. SWISSGESUNDHEITSSCHUH reserves the right to verify credit card payments before accepting this type of payment. In the event of a delay in payment, SWISSGESUNDHEITSSCHUH is entitled to partially or fully suspend all further deliveries to the customer without prior notification until the relevant payment has been received or secured.

In the case of purchase on account, the purchase price is due for payment on the day the customer receives the delivery. If payment is not made within 30 days of the due date, the customer is in default. In this case, SWISSGESUNDHEITSSCHUH reserves the right to charge the customer a reminder fee of CHF 15.00 per reminder in addition to the invoice amount. The open invoice amount (including interest on arrears and reminder fees) can be handed over or sold for collection purposes. In addition to paying the invoice amount, the customer is also obliged to reimburse all costs incurred as a result of the delay in payment.

Rejected shipments will be treated as normal returns. See paragraph 6.

 

5. Retention of Title


Ordered products remain the property of SWISSGESUNDHEITSSCHUH until full payment has been made to SWISSGESUNDHEITSSCHUH.

 

6. Right of Withdrawal and Right of Return
We want them to be happy and satisfied with their GNL shoes. If something doesn't fit, you can return it after receiving a delivery without giving a reason within 30 days of the original invoice date. You can simply return the shoes and get a refund of the amount paid, or you can exchange the shoes.

To request the return procedure from SWISSGESUNDHEITSSCHUH, you must send SWISSGESUNDHEITSSCHUH an email to info@swissgesundheitsschuh.info, provide the delivery note number and indicate that you will be returning the product and whether you want an exchange or a refund of your paid amount. After receiving our confirmation of your return, send the product to:

The product must be returned to SWISSGESUNDHEITSSCHUH in its original condition, i.e. undamaged, clean and in the original packaging.

SWISSGESUNDHEITSSCHUH does not offer a free pick-up service. The customer bears the costs of the return transport.

If the customer has informed SWISSGESUNDHEITSSCHUH that he intends to withdraw from the contract, all amounts owed to SWISSGESUNDHEITSSCHUH will be refunded as soon as possible, at the latest within 30 days of receipt of the ordered goods at our warehouse (shipping costs and import taxes will not be refunded).

Gift certificates and new soles are non-refundable.

 

7. Damage in transit


If, upon receipt of a delivery, the customer finds that the ordered products have been damaged during transport, he must inform the delivery service employee immediately and contact SWISSGESUNDHEITSSCHUH customer service via info@swissgesundheitsschuh.info. Although the customer's guarantee rights remain unaffected if he does not inform the shipping company or SWISSGESUNDHEITSSCHUH of transport damage, it is then more difficult for SWISSGESUNDHEITSSCHUH to assert claims against the shipping company or an insurance company.

 

8. Warranty

 

The warranty period is 6 months. All product defects covered by the warranty will be remedied by SWISSGESUNDHEITSSCHUH free of charge for the customer. SWISSGESUNDHEITSSCHUH's warranty obligations for defective products are limited to rectifying defects or replacing products. Cancellation of the contract or reduction of the purchase price is hereby excluded. Normal wear and tear and product modifications are not covered by the warranty.

The guarantee for resoling is one year from the date of receipt. This does not include wear and tear. SWISSGESUNDHEITSSCHUH accepts no responsibility for repair work carried out by third parties.

 

9. Limitation of Liability


SWISSGESUNDHEITSSCHUH is only liable for direct damage and only if the customer can prove that SWISSGESUNDHEITSSCHUH or third parties commissioned by SWISSGESUNDHEITSSCHUH acted with gross negligence or intentionally unlawfully. In any case, the liability of SWISSGESUNDHEITSSCHUH is limited to the purchase price of the deliveries/services in question. Any further liability on the part of SWISSGESUNDHEITSSCHUH AG or third parties commissioned by it for damage of any kind is hereby excluded. In particular, the customer is not entitled to liability claims for damage that was not caused by the product itself. Examples of this are loss of production, use, orders or profits or other indirect or consequential damages.

 

10. Governing Law and Jurisdiction


For consumers: The contractual relationships within the framework of these GTC between SWISSGESUNDHEITSSCHUH and the consumer are subject to the laws in force at the consumer's place of residence. The place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship between the parties is the competent court at the place of residence of the consumer.

For all other customers: The contractual relationships between SWISSGESUNDHEITSSCHUH and professional customers (resellers) within the framework of these GTC are subject to Swiss law. The application of international contracts, in particular the United Nations Convention of April 11, 1980 on contracts for the international sale of goods (Vienna Sales Convention) is excluded. The place of jurisdiction for all disputes arising directly or indirectly from the contractual relationships between the parties is Zurich, Switzerland. Alternatively, SWISSGESUNDHEITSSCHUH is entitled to sue the customer at the place of jurisdiction at his place of business.

 

11. Final Provisions


If one of the provisions of these GTC is declared invalid, all other provisions remain unaffected. Instead of the invalid provision, the corresponding valid law is to be applied.
